These Terms govern your access to and use of Hestvera, Mochi, and related mobile, web, and family-communication services.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to these Terms and the Privacy Policy. If you do not agree, do not access or use the Services.
Hestvera is operated by Infinite Exploration LLC, a California limited liability company. Hestvera and Mochi (the “Services”) help families stay close through a daily check-in, family circles, short notes, reminders, and gentle alerts when someone hasn't checked in.
You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian where required by applicable law. Hestvera is not directed to children under 13.
By using the Services, you represent that you satisfy these requirements and have the authority to agree to these Terms.
You agree to provide accurate and current information, keep your password confidential, use your account only for lawful purposes, and promptly notify us if you believe your account has been accessed without authorization. If you forget your password, you can reset it with a code we email to you; resetting it signs you out on your other devices. You may not impersonate another person or access another user's account without authorization. You are responsible for activity conducted through your account except to the extent applicable law provides otherwise.
You can create a family circle or join one with its family code. Anyone who has a circle's family code can join that circle and see what its members share. You are responsible for deciding whom you share a family code with. The circle's owner can reset the code at any time; the old code then stops working, and people already in the circle stay in it.
Hestvera does not verify family relationships, caregiving relationships, guardianship, or anyone's authority over another person. Joining a circle does not create a caregiving, fiduciary, medical, or professional relationship between Hestvera and any user.
Members of your family circle can see your name, whether you have checked in today and, if so, your mood and the time, and notes you send to everyone in the circle. A note you send to one person is visible only to you and that person. If you haven't checked in by your circle's daily deadline, the other members may be alerted. The Privacy Policy describes this in more detail.
Hestvera relies on third-party providers for cloud hosting, databases, email delivery, push notifications, text messages, website hosting, security, and other infrastructure. Information is shared with them only as needed to provide the Services. Our Privacy Policy describes these practices.
Do not use notes or support messages to send passwords, Social Security numbers, banking or payment-card details, government credentials, or other secret information. Use appropriate judgment when sharing health or other sensitive personal information with your family circle.
Hestvera is not a healthcare provider and does not provide medical services. Hestvera does not diagnose medical conditions, prescribe treatments, monitor vital signs, provide nursing care, or replace a licensed healthcare professional. Users should consult a qualified professional regarding medical symptoms, diagnoses, medications, treatments, or healthcare decisions.
Hestvera is not an emergency-monitoring system. Check-in reminders and missed check-in alerts are courtesy notifications: they may be delayed, blocked, or not delivered, and a missed check-in does not mean someone is in danger, just as a check-in does not mean someone is safe. Do not rely on Hestvera to detect falls, identify medical emergencies, continuously monitor another person, contact emergency responders, or guarantee that a notification or note is received. If you or another person may be experiencing an emergency, call 911 or your local emergency services immediately.

You must comply with applicable telecommunications, privacy, consumer-protection, and messaging laws, carrier requirements, and provider policies. We may suspend messaging or account access when reasonably necessary to investigate abuse, protect recipients, or comply with these requirements.
“User Content” is information you provide through the Services, including your check-ins, notes, support messages, circle names, and profile information. You retain ownership rights you may have in your User Content. You grant Infinite Exploration LLC a limited, non-exclusive right to host, transmit, reproduce, process, and use User Content as reasonably necessary to provide the Services, process requests you make, maintain and secure Hestvera, prevent misuse, comply with law, and perform activities described in the Privacy Policy. This does not transfer ownership of your User Content. You represent that you have the rights and permissions needed to share your content.
Your privacy is important to us. The Privacy Policy explains how Hestvera collects, uses, shares, keeps, and deletes information, including what members of your family circle can see.
Hestvera sends application-to-person text messages only to recipients who have separately provided the consent required for the applicable message program. Consent is not transferable, is limited to the subject matter described when it is obtained, and is not a condition of purchasing goods or services. You may not enter another person's number or request messages for someone who has not authorized them.
Message frequency varies by account activity, settings, family-circle activity, and message program. Message and data rates may apply. Every initial or recurring SMS program message will identify Hestvera or the applicable sender and include or support clear opt-out instructions. Reply STOP to unsubscribe from the applicable SMS program and HELP for assistance. After an opt-out, we may send one confirmation message, but will not send further messages for that program unless you provide new express consent.
The Mochi app may ask for permission to send notifications, which you can turn on or off at any time in your device settings. SMS messages, push notifications, and other communications may be delayed, blocked, or unavailable because of carrier, device, connectivity, permission, or third-party service issues.
We work to provide reliable Services but cannot guarantee uninterrupted availability. Hestvera may become unavailable because of maintenance, software errors, network interruptions, third-party outages, security events, or circumstances beyond our reasonable control. Hestvera is an evolving product. We may modify, add, remove, suspend, or discontinue features, providers, or infrastructure. Where required by law, we will provide notice of material changes.
Hestvera is currently provided free of charge. We may introduce optional paid services or subscriptions in the future. Before charging for a paid service, applicable pricing and payment terms will be disclosed. Apple App Store and Google Play purchases may also be subject to the applicable platform's payment and subscription requirements.
Hestvera, Mochi, and their software, designs, trademarks, logos, interfaces, graphics, and proprietary technology are owned by or licensed to Infinite Exploration LLC and protected by applicable intellectual-property laws. These Terms provide a limited right to use the Services and do not transfer ownership of Hestvera or its intellectual property.
If you voluntarily provide suggestions, ideas, or other feedback, Infinite Exploration LLC may use that feedback without restriction or compensation, provided that doing so does not transfer ownership of your personal information to us.
To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.” Infinite Exploration LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability to the extent permitted by law. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
To the maximum extent permitted by applicable law, Infinite Exploration LLC and its officers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services. This includes, to the extent permitted by law, damages arising from service interruptions, loss of information, notifications or alerts that are delayed or not delivered, or the failure of another user or family member to check in or respond. Nothing limits liability where prohibited by law.
To the extent permitted by law, you agree to indemnify and hold Infinite Exploration LLC harmless from claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person's rights. This provision does not apply where prohibited by applicable consumer-protection law.
You may stop using Hestvera at any time. We may suspend or terminate access where reasonably necessary because of material violations, unlawful activity, fraud or abuse, threats to user safety or system security, or misuse of the Services. Where appropriate and legally required, we will provide notice.
You can delete your account at any time in the Mochi app under Settings. Your account is hidden right away and permanently deleted after 30 days; logging in during that time lets you restore it. If you own a family circle that others have joined, you choose whether to hand it over to another member or delete it for everyone. Deletion may be subject to limited retention reasonably necessary for legal compliance, fraud prevention, security, dispute resolution, or legal claims. The Privacy Policy has more detail.
If you obtain Hestvera through the Apple App Store, these Terms are between you and Infinite Exploration LLC, not Apple Inc. Infinite Exploration LLC, and not Apple, is responsible for Hestvera and its content. Apple has no obligation to provide maintenance or support services for Hestvera. Apple and its subsidiaries may be third-party beneficiaries of applicable iOS provisions where required by App Store terms.
If you obtain Hestvera through Google Play, your use is also subject to applicable Google Play terms and policies. These Terms are between you and Infinite Exploration LLC. Google is not responsible for support, maintenance, or services relating to Hestvera except as expressly required under applicable Google terms.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Nothing limits rights available to consumers that cannot lawfully be waived.
We may update these Terms to reflect changes to Hestvera, applicable law, technology, or our business practices. When material changes are made, we will update the effective date and provide additional notice where required. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
These Terms, the Privacy Policy, and any additional terms presented for specific features constitute the agreement between you and Infinite Exploration LLC regarding your use of Hestvera.
